Scope of Service

The service provided by "The Good Neighbor Network" is strictly limited to the movement of trash cans from your designated storage location to the curb for pickup, and returning the cans to the storage location after the garbage truck has serviced them.

Our service does not include additional tasks such as:

  • Handling or disposing of hazardous materials (e.g., chemicals, medical waste, batteries, flammable substances).
  • Disposing of non-standard waste items (e.g., large furniture, electronics, construction debris).
  • Cleaning or maintenance of the trash cans themselves.
  • Moving trash bags or loose items that are not contained within the trash cans.
  • Securing or locking trash cans after they have been moved.

The service will be performed regardless of most weather conditions; however, in the event of severe or unsafe weather conditions (e.g., heavy snow, ice, storms), "The Good Neighbor Network" reserves the right to reschedule the service to ensure the safety of our employees. You will be notified of any changes to the service schedule due to weather.

The service is provided on a regular, scheduled basis according to your designated garbage pickup day. There may be variations in the time of day the service is performed, but it will typically occur within a specified window depending on the municipality’s garbage pickup schedule. You are responsible for making sure that the necessary access arrangements (e.g., unlocking gates, securing pets) are in place for the entire duration of the service window.

If our employees are unable to perform the service due to obstructions, locked gates, or unsafe conditions on the property, you will be notified. If the issue is not resolved, the service for that period may be skipped at our discretion. 

You acknowledge and agree to adhere to the service limitations outlined by "The Good Neighbor Network," understanding that our employees are only authorized to perform specific tasks related to moving trash cans. Any requests for additional services beyond the agreed scope must be discussed and formally agreed upon in writing.

Permission & Access

By subscribing to "The Good Neighbor Network" service, you grant permission for our employees to enter your property for the purpose of moving trash cans to and from the curb on scheduled pickup days. This access includes but is not limited to the front yard, driveway, side yard, and any other areas necessary to perform the service. You also grant permission for our employees to enter the property to maintain, inspect, and replace any equipment provided as part of the service, such as QR luggage tags.

All employees of "The Good Neighbor Network" will carry identification and will be in uniform when performing the service. You may request to see identification if there is any doubt about the identity of the person performing the service.

Our employees are authorized to access only the exterior areas of the property necessary to perform the service. This typically includes the front yard, driveway, side yard, and any direct path to and from the trash cans. Our employees are not permitted to enter any buildings, garages, sheds, or other enclosed spaces unless explicitly agreed upon in writing. If access to such areas is required, it must be arranged and documented in advance.

You acknowledge that "The Good Neighbor Network'' may perform the service at any time during the designated service day, and that our employees may need to access the property even if you are not present. In the event of service cancellation, you grant permission for our employees to enter the property to remove any equipment provided as part of the service, such as QR luggage tags. This access will be coordinated with you to ensure minimal disruption. You agree to facilitate this access by providing any necessary instructions or permissions to retrieve the equipment in a timely manner.

In addition, you warrant that you are the owner of the property where the service will be performed or that you have obtained all necessary permissions from the property owner to grant access to "The Good Neighbor Network" for the purposes described herein. You agree to indemnify and hold "The Good Neighbor Network" harmless from any claims, damages, or liabilities arising from a breach of this warranty.

Safety & Security

You agree to provide unobstructed and safe access to the trash cans at all times on the scheduled service day. This includes ensuring that the path to the trash cans is free from obstacles such as vehicles, toys, garden equipment, and other items that could impede access or cause injury. In addition, you agree that any gates, fences, or barriers are securely fastened or arranged to allow safe and unobstructed access to the trash cans. You agree to be responsible for ensuring that pathways and access points are well-maintained and safe for our employees. This includes clearing snow, ice, leaves, and other debris that could cause slipping or tripping hazards. You agree to provide adequate lighting around the areas where our employees will be working, especially if the service is performed during early morning or evening hours.

You agree to secure any pets or animals that may pose a risk to our employees during the scheduled service times. This includes ensuring that dogs, cats, or other animals are kept indoors or in a secure area away from the path of access to the trash cans. 

If our employees are unable to access the trash cans due to locked gates, obstructed paths, other barriers, or conditions, you will be notified, and the service may be skipped for that period at our discretion and In the event of severe weather conditions, such as heavy snow, ice storms, or extreme winds, "The Good Neighbor Network" reserves the right to reschedule the service for the safety of our employees.

Condition of Trash Cans

You are responsible for ensuring that the trash cans are in a condition suitable for movement. This means that they should not be overfilled, excessively heavy, or damaged in a way that makes them difficult or unsafe to move. You agree to regularly inspect the trash cans for any damage or wear that could affect their functionality. This includes checking for cracks, broken wheels, and damaged handles. Trash cans should be placed in a manner that prevents tipping or spilling, especially in windy or inclement weather.  

Prompt repair or replacement of damaged trash cans is required to ensure continuous service. You should contact your local waste management authority for repair or replacement options.

You agree to adhere to any weight limits specified by the local waste management authority for trash cans and you are responsible for ensuring that trash can lids are properly closed to prevent waste from spilling out and to protect the contents from animals, weather, and other environmental factors. Trash cans with missing or broken lids should be repaired or replaced by you to maintain hygiene and safety standards set by the local community. 

If a trash can is found to be unsuitable for movement due to overflowing, excessive weight, or damage, "The Good Neighbor Network '' reserves the right to skip the service for that can. In the event that our employees deem the trash can unsuitable for movement, you will be notified of the issue and advised on how to correct the issue for future service.

Hazardous Materials

You agree not to place any hazardous materials in the trash cans serviced by "The Good Neighbor Network." Hazardous materials include, but are not limited to:

  • Chemicals (e.g., cleaning agents, pesticides, solvents)
  • Medical waste (e.g., needles, syringes, pharmaceuticals)
  • Batteries (e.g., automotive, lithium-ion)
  • Flammable substances (e.g., gasoline, propane, oil)
  • Explosives (e.g., fireworks, ammunition)
  • Toxic materials (e.g., asbestos, lead-based products)
  • Electronic waste (e.g., computers, televisions, cell phones)

These materials pose significant health and safety risks to our employees, the public, and the environment. Our employees are not equipped or authorized to handle such materials.

You are responsible for identifying any hazardous materials in your possession and ensuring they are disposed of in accordance with local regulations. We encourage you to contact "The Good Neighbor Network" if you are unsure whether a material is considered hazardous. 

Most municipalities have designated facilities or special collection days for hazardous waste disposal. You may contact your local waste management authority for guidance on how to properly dispose of hazardous materials.

If hazardous materials are found in your trash can, "The Good Neighbor Network" reserves the right to immediately suspend service until the issue is resolved. Repeated violations may result in permanent cancellation of the service, and you may be liable for any damages or injuries resulting from the improper disposal of hazardous materials.

In cases where hazardous materials pose a significant risk to health and safety, "The Good Neighbor Network" may report the violation to local authorities for further action.

You agree to indemnify and hold "The Good Neighbor Network" harmless from any claims, damages, or liabilities arising from the improper disposal of hazardous materials.

Subscription Billing & Auto-Renewal

Your subscription to the Services includes enrollment into an ongoing/recurring payment plan. Your subscription will automatically renew at the end of the disclosed billing period, unless canceled in accordance with the instructions for cancellation below. Payment will be charged to your chosen payment method at confirmation of purchase and at the start of every new billing period, unless canceled. 

Your “billing period” is the interval of time between each recurring billing date and corresponds to the term of your subscription. For purposes of this Agreement, a “day” or “date” begins at 12:00 a.m. Mountain Standard Time (MST) and ends at 11:59 p.m. Mountain Standard Time (MST) of that same calendar day. Where applicable, charges for one or more Services may be prorated for any partial month of service. To see your next recurring billing date, log in to your account and view your account details. You acknowledge that the timing of when you are billed may vary, including (i) if your subscription began on a day not contained in a given month (e.g. if you have a monthly subscription and became a paying subscriber on January 31, your payment method would be billed next on February 28), or (ii) due to free trials and other promotional offers, gift card redemptions, credits applied, or changes in your subscription or payment method. 

We may also offer you the ability to pause your subscription for a specified period of time. If you do not cancel before the end of the pause period, billing will resume automatically. We reserve the right to change our pricing. In the event of a price change, we will attempt to notify you in advance of the change by sending an email to the email address you have registered for your account. If you do not wish to accept a price change, you may cancel your subscription in accordance with the instructions included in that email and below. If you do not timely cancel your subscription, your subscription will be renewed at the price in effect at the time of the renewal, without any additional action by you, and you authorize us to charge your payment method for these amounts. We will not be able to notify you of any changes in applicable taxes. 

Payment Details

We will keep your detailed payment information, such as credit card number and expiry date, on file. You are responsible for keeping your payment details up-to-date by changing the details in your account settings. Where your details change or are due to expire, we may obtain or receive from your payment provider updated payment details including your card number, expiry date and CVV (or equivalent). This enables us to continue to provide you access to the Services. You authorize us to continue to charge your card using the updated information.

Failed Payments

In the event of a failed attempt to charge to your payment method (e.g. if your payment method has expired), we reserve the right to retry billing your payment method. If a payment is not successfully authorized due to expiration, insufficient funds, or otherwise, we may suspend or terminate your subscription. You will remain responsible for any amounts you fail to pay in connection with your subscription, including collection costs, bank overdraft fees, collection agency fees, reasonable attorneys’ fees, and arbitration or court costs. You also agree that we may charge your payment method on file if you decide to restart your subscription. 

Notices

Any notices we deliver to you may be made as follows: (i) by email to the last email address provided by you or (ii) by posting a notice on the Services. For clarity, you consent to receive electronic communications from the Services you subscribe to and further agree that any notices, agreements, disclosures, and other communications that we send to you electronically will satisfy any applicable legal notification requirements. You agree to provide and maintain accurate, current and complete information, including your contact information for notices and other communications from us. You agree not to impersonate or misrepresent your affiliation with any person or entity, including using another person’s username, password or other account information, or another person’s name or likeness, or provide false details for a parent or guardian. You agree that we may take steps to verify the accuracy of information you provide.

Cancellation & Refund Policy

YOU CAN CANCEL YOUR SUBSCRIPTION AT ANY TIME BEFORE THE END OF THE CURRENT BILLING PERIOD, FREE TRIAL OR PROMOTION. CANCELLATION WILL TAKE EFFECT AT THE END OF THE CURRENT BILLING PERIOD UNLESS OTHERWISE DISCLOSED. If you cancel, you will continue to have access to the service through the end of your current billing period, unless you are subscribed through a free trial, promotional code or other credit, in which case cancellation may be effective immediately. If you modify your subscription to switch from one service to another service during your billing period, you may not have continued access to your original service. 

YOU MUST CANCEL YOUR SUBSCRIPTION PRIOR TO 11:59 P.M. MOUNTAIN STANDARD TIME (MST) ON THE DAY BEFORE YOUR NEXT RECURRING BILLING DATE IN ORDER TO AVOID BEING CHARGED FOR THE NEXT BILLING PERIOD. We do not refund or credit for partially used billing periods, although we may provide such refunds or credits on a case-by-case basis in our sole and absolute discretion. If you cancel, or if your subscription is canceled due to failed attempts to charge your payment method, or if you switch your billing to a third-party, you will forfeit any service, referral, or redeemed gift card credits.

To cancel your subscription, you may login into your account and cancel your subscription directly, or you can email sales@thegoodneighbornetwork.com, or call 505-585-1185 and speak with one of our representatives. 

Suspension & Termination

You agree that we may, in our sole discretion and without notice or liability to you, restrict, suspend, or terminate your access to part or all of the Services if we believe you are using or have used the Services in violation of this Agreement or applicable law or regulations or in any manner other than for their intended purpose and in accordance with all other guidelines and requirements applicable thereto. 

Without limiting the foregoing, we may restrict or suspend your access to your The Good Neighbor Network account for cause, which cause includes but is not limited to (a) requests from law enforcement or other government authorities, (b) unexpected technical issues or problems, or (c) if we reasonably believe that your The Good Neighbor Network account has been created fraudulently, your The Good Neighbor Network account has been accessed fraudulently, or anyone uses your The Good Neighbor Network account to commit fraud or for any purpose other than its intended purpose and in accordance with all of the requirements applicable thereto.

You agree that we will not be liable to you or to any third party for any such restriction, suspension, or termination of your access to your The Good Neighbor Network account. 

We also reserve the right to take appropriate legal action against you for violating intellectual property rights, fraud, or similar grounds for termination.

Our decision to delay exercising or enforcing any right or remedy under this Agreement will not constitute a waiver of such right or remedy with respect to any party.

UPON TERMINATION OF YOUR THE GOOD NEIGHBOR NETWORK ACCOUNT, WHETHER TERMINATED BASED ON OUR DETERMINATION OR AT YOUR REQUEST (OTHER THAN A CANCELLATION OF YOUR SUBSCRIPTION, IN WHICH CASE YOUR SUBSCRIPTION WILL CONTINUE TO THE END OF THE BILLING PERIOD), YOU WILL LOSE THE RIGHT TO ACCESS THE SERVICES.

Damage & Liability

"The Good Neighbor Network" is committed to providing a high level of care in handling your trash cans and property. However, you acknowledge that minor wear and tear may occur as a result of regular service. "The Good Neighbor Network" is not liable for any damage to trash cans or property resulting from normal service operations, provided that our employees exercise reasonable care.

If any damage to the trash cans or property is noticed, you must report it to "The Good Neighbor Network" within 24 hours of the service. This prompt reporting ensures that the issue can be investigated and addressed in a timely manner. Reports of damage should include detailed descriptions and, if possible, photographs to facilitate the assessment process.

Upon receiving a report of damage, "The Good Neighbor Network" will promptly investigate the claim. This may involve reviewing service logs, employee statements, and any available photographic evidence. If the investigation confirms that the damage was caused by our employees due to negligence or failure to follow proper procedures, "The Good Neighbor Network" will take appropriate steps to repair or compensate for the damage.

You must cooperate with "The Good Neighbor Network" during the investigation of any damage claims. This includes providing access to the property and any relevant information or documentation requested. Failure to cooperate or provide timely information may result in the denial of the damage claim.

You are responsible for any damage to the trash cans or property that occurs as a result of your own actions, such as overfilling trash cans, placing hazardous materials in the cans, or failing to maintain safe access pathways.

"The Good Neighbor Network" limits its liability to the direct costs of repair or replacement of damaged items caused by our employees. Indirect or consequential damages, such as loss of use or business interruption, are not covered under this agreement. The total liability of "The Good Neighbor Network" for any claims arising from the service shall not exceed the total fees paid by the customer for the service during the preceding three months.

"The Good Neighbor Network" is not liable for any failure to perform, or delay in performing, any service due to circumstances beyond our reasonable control. This includes, but is not limited to, natural disasters, extreme weather conditions, acts of terrorism, and government actions.

In the event of a force majeure event, "The Good Neighbor Network" will make reasonable efforts to notify customers and resume service as soon as practicable.

Indemnification

You agrees to indemnify, defend, and hold harmless "The Good Neighbor Network," its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

  • Your breach of any term or condition of this agreement.
  • Your negligence or willful misconduct in relation to the use of our services.
  • Any injury or damage caused by hazardous materials improperly disposed of in your trash cans.
  • Any damage to property or personal injury resulting from your failure to maintain safe access to the trash cans, including obstructions or unsafe conditions.

The indemnification obligations set forth in this section shall survive the termination or expiration of this agreement.

The liability of either party for any claim arising out of this agreement shall be limited to direct damages only, and neither party shall be liable for any indirect, incidental, consequential, special, or punitive damages, even if advised of the possibility of such damages.

Waiver

The failure of "The Good Neighbor Network" to enforce any provision of these terms and conditions does not mean we waive that provision or any other rights. For example, if we choose not to act on a minor breach, it does not mean we have lost our right to act on more significant breaches in the future.

Any delay or omission in exercising rights or remedies does not imply a waiver of those rights. If we address one issue, it does not prevent us from addressing other issues or using additional remedies.

Any waiver must be documented in writing and signed by an authorized representative, such as a manager or director, to be effective. This means that verbal agreements or informal actions are not considered waivers.

A waiver on one occasion does not prevent us from enforcing that term or condition in the future. Our rights and remedies are cumulative, meaning they work together to address issues. This ensures that if one remedy does not resolve a problem, we can still use other remedies.

By subscribing to our services, you acknowledge and agree to these waiver terms, confirming that you understand how they help us maintain our rights and remedies in a fair manner.

Insurance

You are encouraged to review your own homeowner's or renter's insurance policies to understand what is covered under your personal insurance. "The Good Neighbor Network" recommends that you maintain adequate property insurance to cover any additional risks or potential gaps in coverage.


Definitions

Access Point: The designated location or entryway on a property that provides our employees with the necessary access to perform the service. This includes any gate, path, or opening that allows employees to reach the trash cans and perform their duties, such as moving them to and from the curb. The access point should be clear of obstructions and properly maintained to ensure safe and efficient service. It may include front yards, driveways, side yards, or any other areas that facilitate access to the trash cans.

Agreement: The binding contract between "The Good Neighbor Network" and the Customer, which includes these Terms and Conditions, any service-specific agreements, and any other documents or communications that outline the rights, responsibilities, and obligations of both parties related to the provision of the services. This Agreement governs the relationship between the parties and is enforceable upon acceptance by the Customer.

Billing Cycle: The recurring period of time for which "The Good Neighbor Network" invoices Customers for their Subscription services. The Billing Cycle typically spans one month, starting from the initial date of Subscription or the end of any Trial Period. During each Billing Cycle, Customers are charged the Subscription fee as agreed upon. The Billing Cycle may be adjusted or prorated based on the start date of the Subscription, changes in service, or other factors as specified in the terms and conditions of the agreement.

Billing Date: The specific date on which "The Good Neighbor Network" generates and sends out invoices for the subscription or service charges. This date marks the start of the billing period for which charges will be assessed. The billing date is used to determine the due date for payment and to calculate any applicable fees or adjustments for the subscription or service provided.

Cancellation: The act of formally terminating or ending the Subscription to "The Good Neighbor Network" service before the end of the agreed-upon term. Cancellation can be initiated by the Customer or by "The Good Neighbor Network" in accordance with the terms outlined in the Agreement. Upon cancellation, the Customer must adhere to any requirements for returning or removing equipment and may be subject to any applicable cancellation fees or conditions as specified in the Agreement. Cancellation does not relieve the Customer of any outstanding payments due for services rendered prior to the cancellation date.

Curb: The edge or boundary of a roadway, typically made of concrete, where the street meets the sidewalk or the property line. In the context of our service, the curb refers to the location where trash cans are placed for collection by municipal garbage trucks. This area is typically adjacent to the street and is designated for the temporary placement of trash cans during scheduled pickup days. The curb may be in front of the property, alongside the street, or in another specified location as determined by local regulations and the customer's service agreement.

Customer: An individual or entity who subscribes to and utilizes the services provided by "The Good Neighbor Network." This includes anyone who has agreed to the terms and conditions of service, and who is responsible for maintaining an active subscription, ensuring access to their property for the service, and adhering to all related terms.

Employee: Any individual who is directly employed by or contracted by "The Good Neighbor Network" to perform the services offered. Employees are required to carry identification and wear a uniform while on duty. They are authorized to access specific areas of a customer’s property as necessary to carry out the services, including moving trash cans to and from the curb and managing any provided equipment, in accordance with the terms and conditions of service.

Equipment: Any items, tools, or devices provided by "The Good Neighbor Network" to facilitate the performance of services. This includes, but is not limited to, QR Tags, bins, tags, or other related accessories used to identify, manage, or track trash cans and service activities. Equipment remains the property of "The Good Neighbor Network" and must be returned upon termination of the Subscription or upon request. The Customer is responsible for the care and maintenance of the Equipment while it is in their possession and may be liable for any damage or loss.

Excessive Weight: A condition in which a trash can, including its contents, exceeds the maximum weight limit specified by "The Good Neighbor Network" or industry standards. Excessive weight can occur when the trash can is filled with an unusually large amount of waste, making it difficult or unsafe for employees to handle, move, or perform the service. Trash cans with excessive weight may cause delays in service, potential damage to equipment, or increased risk of injury.

Hazardous Waste: Waste materials that pose substantial or potential threats to public health or the environment due to their chemical composition or properties. Hazardous waste includes substances that are toxic, flammable, corrosive, reactive, or otherwise dangerous. Examples of hazardous waste include chemicals, pesticides, batteries, paint solvents, and certain medical or industrial by-products. Proper handling, storage, and disposal of hazardous waste are regulated by environmental and safety laws to prevent harm.

Loose Items: Items that are not securely contained within a trash can or other designated receptacle, and are instead left uncontained or scattered around the property. These items may include, but are not limited to, loose trash, yard waste, or other refuse that is not properly bagged or contained. Loose items can pose a risk of spillage, attract pests, or cause inconvenience and may require additional handling or cleanup efforts.

Minor Breach: A failure to comply with the terms and conditions of an agreement that is relatively small or insignificant in nature and does not substantially affect the overall performance of the agreement. A minor breach may involve non-compliance with less critical provisions or terms that do not materially impact the core obligations or responsibilities of the parties involved. Such breaches are typically rectifiable and do not result in substantial harm or loss.

Minor Wear: Normal and expected deterioration or usage of equipment or property that occurs over time due to routine use. This includes, but is not limited to, minor scratches, scuffs, or slight discoloration that does not impair the functionality or safety of the equipment or property. Minor wear is considered a natural consequence of regular use and does not necessitate repair or replacement under standard terms and conditions.

Non-Standard Waste: Items that do not fall within the typical categories of household or municipal waste and are not suitable for regular curbside disposal. Non-standard waste includes, but is not limited to, large or bulky items such as furniture, appliances, electronics, construction debris, hazardous materials (e.g., chemicals, batteries, paints), and other specialized refuse that requires special handling, disposal, or recycling processes. This type of waste often requires separate arrangements for removal and disposal.

Obstructions: Any physical or environmental barriers that hinder or prevent access to or movement of trash cans during service. Obstructions may include, but are not limited to, vehicles, landscaping features, construction materials, furniture, or other items placed in the path of the trash cans. Obstructions can also involve locked gates, barriers, or any other items or conditions that obstruct the direct route between the designated storage location and the curb or pickup point.

Overfilled: A condition in which a trash can exceeds its intended capacity, causing it to be excessively full or overflowing. This situation occurs when the contents of the trash can surpass the top edge or rim, making it difficult to handle, move, or close the lid. Overfilled trash cans may result in improper service, including potential delays or issues with waste management, and can affect the efficiency of the trash collection process.

Pathways: Designated routes within the customer's property that employees of "The Good Neighbor Network" may use to access and move trash cans. These can include walkways, driveways, side yards, or other clearly defined areas that lead to and from the location of the trash cans. Customers may specify any restrictions or preferences regarding the use of specific pathways to ensure safe and efficient navigation while preventing any damage or inconvenience.

Payment Method: The approved method of payment that a Customer uses to pay for Subscription services with "The Good Neighbor Network." Payment Methods may include credit cards, debit cards, electronic funds transfers, or other forms of payment accepted by the company. Customers are required to provide accurate and current payment information, which will be used to process charges for Subscription fees and any applicable additional costs. It is the Customer’s responsibility to ensure that their Payment Method remains valid and has sufficient funds or credit to cover the charges during each Billing Cycle.

Payment Provider: A third-party service or financial institution responsible for processing and handling payments on behalf of "The Good Neighbor Network." This includes managing transactions, ensuring secure processing of payment information, and facilitating the transfer of funds between the customer’s payment method and "The Good Neighbor Network." Payment providers may include credit card processors, online payment platforms, and other financial services used to collect and manage payments.

Property: The physical location or premises where the Customer resides or operates, as specified in the Agreement, and where "The Good Neighbor Network" is authorized to perform the services. This includes all areas accessible to our employees for the purpose of performing the services, such as the front yard, driveway, side yard, backyard, and any pathways leading to and from the trash cans. The Property must be within the defined Service Area to qualify for service.

QR Tag: A unique, scannable code attached to the customer’s trash can by "The Good Neighbor Network" for identification and tracking purposes. The QR Tag enables real-time service updates and ensures that the correct trash cans are serviced according to the customer's subscription. Scanning the QR Tag allows employees to log and verify service completion, track the trash can’s location, and maintain accurate service records.

Reasonable Care: The standard of care expected from a prudent and cautious individual or entity in similar circumstances. It refers to the level of attention, caution, and diligence that a reasonable person would exercise to prevent harm or damage. In the context of our service, reasonable care involves handling property, equipment, and tasks with appropriate caution and attention to ensure no unnecessary damage or risk is incurred. Regular Service: The ongoing, scheduled maintenance or provision of services as outlined in the subscription agreement, performed at consistent intervals according to the agreed-upon schedule. This service includes the tasks specified in the scope of service and occurs on predetermined days, typically based on the customer’s subscription plan. Regular service ensures the systematic and timely execution of agreed-upon tasks and responsibilities, contributing to the consistent upkeep and functionality of the service provided.

Service Area: The specific geographic region or boundary within which "The Good Neighbor Network" provides its trash can management services. The Service Area may be subject to change at the discretion of "The Good Neighbor Network." Customers must reside within this designated area in order to subscribe to the services, and the service availability is limited to properties within the approved boundaries, which include Gallup, NM, and surrounding areas as specified by "The Good Neighbor Network."

Service Day: The designated day of the week on which "The Good Neighbor Network" provides trash can management services to a customer's property. On the service day, employees will move trash cans to and from the curb, as well as perform any other agreed-upon services. The service day is assigned based on the customer's local trash pickup schedule and may vary due to holidays or other special circumstances, which will be communicated in advance.

Service Updates: Notifications provided by "The Good Neighbor Network" to inform customers about the status of their service. These updates may include real-time information about the completion of trash can movements, scheduled service times, any delays or changes, and any other relevant updates regarding the customer’s subscription. Service Updates are delivered through various communication channels such as email, SMS, or mobile app notifications.

Subscription: A recurring agreement between the customer and "The Good Neighbor Network" for ongoing trash can management services. The subscription is billed at a fixed rate, typically on a monthly basis, and automatically renews until canceled by the customer. The subscription includes regular services as outlined in the service plan and may be subject to additional terms and conditions, such as renewal dates, payment schedules, and trial periods.

Trash-Can: Refers to any container or bin provided by the customer or a third party, used for the temporary storage of residential waste, recyclables, or organic materials, and intended to be moved to and from the designated curbside location by The Good Neighbor Network for collection by local waste management services. Trash-Cans may vary in size, shape, and material, but must be equipped with secure lids and meet local waste collection requirements.

Trial Period: A specified duration during which new Customers are provided with a complimentary or reduced-cost Subscription to "The Good Neighbor Network" services, allowing them to evaluate the quality and effectiveness of the service. The Trial Period typically lasts for 30 days but may vary based on promotional offers. To qualify for the Trial Period, Customers must meet all eligibility requirements, including but not limited to, being within the defined Service Area and setting up service within the designated time frame. The Trial Period is subject to the terms and conditions set forth by "The Good Neighbor Network," and any services used beyond this period may incur standard Subscription fees.

Unsafe Weather: Weather conditions that are deemed hazardous or potentially dangerous for performing outdoor activities, including but not limited to severe storms, heavy snow, ice, high winds, or extreme temperatures. Unsafe weather conditions can impair visibility, create slippery surfaces, or pose other risks to safety, making it unsafe for employees to perform services or operate equipment. The determination of unsafe weather is typically based on local weather advisories and conditions that could endanger the well-being of individuals or cause damage to property.
